Prayer: Writ Petition filed Under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus, directing the respondents herein to issue orders of appointment to the petitioner for the appointment of Secondary Grade Teacher as per the certificate verification conducted on 07.10.2009 on par with the similarly placed persons like K. Thilagavathy and M.R. Balasubramanian.

The relief sought for in the present writ petition is to direct the respondents to issue orders of appointment to the writ petitioner to the post of Secondary Grade Teacher as per the certificate verification conducted on 07.10.2009.

The grievance of the writ petitioner is that she participated in the process of certificate verification conducted by the respondents on 07.10.2009 and she was not issued with an order of appointment. The petitioner states that the candidates totally 5581 were provisionally selected as Secondary Grade Teacher for appointment in the Department of elementary education based on the employment registration, seniority,
communal roaster and based on the priority category. The petitioner was sponsored and participated in the process of certificate verification. The petitioner was not selected during the relevant point of time but the writ petition is filed after a lapse of about five years from the date of certificate verification. In between the recruitment procedure underwent changes and the teachers recruitment board was constituted for the purpose of selecting teaching staff in education department. Now the selection has been made through open competition process and therefore the petitioner has to participate in the process of selection if any notification is issued by the teachers recruitment board. Based on the certificate verification conducted on 07.10.2009, the direction as such sought for issuing an appointment order, cannot be granted and thus the writ petition is devoid of merits and stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
