This petition has been filed to direct the respondent Police to file the charge sheet in Crime No.237 of 2023 before the Court concerned. 1/5

The learned Government Advocate (Crl.Side) appearing for the respondent would submit that apart from the First Information Report in Crime No.237 of 2023 was registered and transferred by the respondent Police registered to the file of the Inspector of Police, CCB, Avadi, one more FIR in Crime No.3 of 2023 has also been registered before the Inspector of Police, EOW, Chennai in respect of the petitioner. He would further submit that both the First Information Reports may be clubbed together.

3. Heard the learned counsel appearing on either side and perused the materials placed on record.

4. Whenever any information in relation to commission of cognizable or non cognizable offence is received, the police officer shall adhere to the procedure contemplated under Sections 173 & 174 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and after conducting necessary enquiry/investigation, file final report under Section 193 of the Bharatiya Nagarik Suraksha Sanhita, 2023. Such investigation under Chapter XIII of the the Bharatiya Nagarik Suraksha Sanhita, 2023 shall be completed without any unnecessary delay. The delay in filing a final report in the 2/5

present case is inordinate and unjustified. Hence, it would be appropriate to direct the Investigating Officer to file a final report within a stipulated time, if not already filed.

Considering the facts and circumstance of the case, this Court directs the Inspector of Police, CCB, Avadi and the Inspector of Police, EOW, Chennai to complete the investigation in Crime No.237 of 2023 and Crime No.3 of 2023 pending on their file respectively and file a final report within a period of six months from the date of the receipt of a copy of this Order.
