Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorari, calling for the records of the 1st respondent pertaining to his proceedings in Na.Ka.No.566/2013 Sa.Pa and quash the order dated 13.10.2014 and pass further orders. O R D E R

The petitioner has filed the present writ petition challenging the impugned proceedings of the 1st respondent in Na.Ka.No.566/2013 Sa.Pa dated 13.10.2014 and quash the same.

2. Learned counsel for the petitioner would submit that he is the elected President of the 3rd respondent Society. Whileso, based on the request made by 7 Directors out of 11 Directors/ members of the 3rd respondent society, the 1st respondent initiated 'No Confidence Motion' under Rule 62(2) of the Tamil Nadu Co-operative Societies Rules against the petitioner and issued the impugned proceedings dated 13.10.2014 directing the 2nd respondent to conduct a Special Meeting, pass a resolution and submit a report.

Challenging the said proceedings, the petitioner has filed the present writ petition before this Court.

3. At the time of admission, this Court by order dated 29.10.2014 granted interim stay of the proceedings, for a period of four weeks. Thereafter, the matter came up for hearing on 28.06.2017 and was posted today for final hearing. Learned counsel for the petitioner would submit that the impugned notice dated 13.10.2014 has now become infructuous. Therefore, no further adjudication is required in the present writ petition.

4. In the light of the above submissions, the writ petition is dismissed as infructuous. Consequently, the M.P. No.1/2014 is closed and the implead petition in M.P. No.2/2014 is dismissed. No costs.
