Prayer : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the second respondent to register the death of Muralidaran S/o.K.Madhavan who died on 28.12.2008 at No.52/21, Mandaveli Street, Puzhuthivakkam, Chennai 91 and issue a death certificate for the same based on the report of the fourth respondent. ORDER

This Writ Petition is filed for a Writ of Mandamus, directing the second respondent to register the death of Muralidaran S/o.K.Madhavan who died on 28.12.2008 at No.52/21, Mandaveli Street, Puzhuthivakkam, Chennai 91 and issue a death certificate for the same based on the report of the fourth respondent.

2. The greivance of the petitioner is that the petitioner's brother one Muralidharan died on 28.12.2008. The said death was not reported and therefore was not registered. Therefore in accordance with Rule 9 (3) of the Tamil Nadu Registration of Births and Deaths Rules, an application is preferred before the District Magistrate namely, the second respondent and the Village Administrative Officer has submitted a report and the enquiry is pending. Therefore the Writ Petition is filed.

3. When the matter came up for admission, the learned Government Advocate taking notice on behalf of the respondents submit the second respondent will complete the enquiry and pass final orders thereon.

4. In view thereof, this Writ Petition is disposed of on the following terms;

(i) The second respondent is directed to complete the enquiry with reference to issue of death certificate of the said Muralidaran son of Madhavan and pass final orders thereon and if the second respondent finds that there was a 3/6

death and it was not registered, accordingly, final orders shall be passed and death certificate to be issued; (ii) The aforesaid exercise shall be completed within a period of four weeks from the date of receipt of the web copy of the order, without waiting for the certified copy of the order.

(iii) No costs.
