ORDER

The petitioner, who was arrested and remanded to judicial custody on 28.02.2026 for the alleged offences under Section 8(c), 20(b)(ii)(A), 25 and 29(1) of NDPS Act, 1985 in Cr. No.110 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on secret information, while the respondent police conducted vehicle checkup near Chinnandi Madam T.H. Road Junction, Kodungaiyur on 23.02.2026 at about 21.30 hours, intercepted A1 to A6 who were standing in a suspicious manner with two motorbikes and on enquiry and search, 54 grams of Methamphetamine was recovered from the possession of A1 along with 20 empty plastic sachets and 200 grams of Ganja was recovered from A2. The respondent police secured the accused and seized the contraband and hence the case.

3. The learned counsel for the petitioner would submit that there are about 8 accused and this petitioner is A5. He would further submit that according to the prosecution, the total recovery of contraband is 54 grams of Methamphetamine, whereas there was no recovery from this petitioner and he has been remanded to judicial custody on 28.02.2026 and there are no bad antecedents against this petitioner and hence prayed to enlarge the petitioner on bail.

However, the learned Government Advocate (Criminal side) appearing for the respondent police would submit that this petitioner has criminal conspiracy with A1 and 54 grams of Methamphetamine has been recovered from A1 and this petitioner has assisted in the sale of the property and therefore, the recovery from A1 would suffice even against this petitioner and since the

recovery of contraband is a commercial quantity, the rigors under Section 37 of NDPS Act would attract and investigation is still pending. Therefore, he strongly objected the bail application.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

Though the learned counsel for the petitioner submitted that there was no recovery effected from this petitioner, as rightly submitted by the learned Government Advocate that there is a criminal conspiracy and investigation is still pending and the recovery from A1 is 54 grams of Methamphetamine being a commercial quantity, this Court is of the firm view that it is too premature to go into recovery aspect at this juncture and there are no materials to overcome the rigors under Section 37 of NDPS Act. Therefore, this Court is not inclined to enlarge the petitioner on bail.

7. Accordingly, this Criminal Original Petition is dismissed. 04-06-2026 MJS
