PRAYER: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondent to consider and process the application of the petitioner, dated 23.06.2015 submitted for issuance of patta in favour of the petitioner.

It is the case of the petitioner that patta originally stood in the name of his father for different survey numbers. The petitioner's father is said to have died in the year 2014. It is seen from the legal heirs' certificate dated 13.11.2014 that a release deed is said to have executed in favour of the petitioner on 18.03.2015. Thereafter, an application was made on 23.06.2015 to the respondent, seeking change of patta. As the same has not been considered, the present Writ Petition is filed. 2.

Mr.A.Kumar, learned Special Government Pleader, takes notice on behalf of the respondent. By consent of both sides, the Writ Petition itself is taken up for final hearing. https://hcservices.ecourts.gov.in/hcservices/

Taking note of the pendency of the representation and without going into the merits of the representation, this Court is constrained to direct the respondent to dispose of the representation of the petitioner, dated 23.06.2015 on merits and in accordance with law, after due enquiry by calling the petitioner as well as the third party if so required, and pass appropriate final orders within a period of eight weeks from the date of receipt of a copy of this order. This Writ Petition is disposed of accordingly. Consequently connected miscellaneous petition is closed.No costs.
