These applications have been filed seeking leave to institute the suit within the jurisdiction of this Court and to dispense with the issuance of the file statutory notice viz., notice under Section 80 of CPC to the 14th respondent.

2. The suit had been filed seeking partition and separate possession of the properties which had been described in the schedule to the plaint and also for a declaration that two settlement deeds are null and void and not binding on the plaintiffs and for a declaration that a partition deed is also not binding on the plaintiffs and for permanent injunction.

3. Some of the properties are within the jurisdiction of this Court and few other properties are outside the jurisdiction of this Court. Some of the defendants are residing within the jurisdiction of this Court and some of the defendants are residing outside the jurisdiction of this Court.

4. However, since part of cause of action had arisen within the jurisdiction of this Court, leave is sought.

5. Hence, leave is granted. Registry is directed to number the suit if it is otherwise in order.

6.In view of the reasons stated, dispense with is also granted for the present.
