O R D E R

The present criminal original petition has been filed to call for the records relating to summons issued by the respondent dated 23.10.2015 against the petitioner and quash the same.

2. The petitioner, who is a permanent resident of Chennai is engaged in the business of Rock Breaker Spares. He was issued with summons on 23.10.2015 by the respondent police for his appearance before them for production of original documents relating to the complaint lodged by one M.K.Suvamiyappan against one K.Moorthy.

3. According to the learned counsel for petitioner, the said summon is issued against the petitioner not in consonance with Sections 91(2) and 160(1) of Cr.P.C.

4. It was contended by the learned Additional Public Prosecutor that the said summon was issued only for production of the documents relating to the complaint lodged by one M.K.Suvamiyappan.

5. Earlier, this Court, by order dated 25.11.2015, directed the petitioner herein to appear before the respondent police on 4.12.2015 at 10.30 a.m., with required documents. The petitioner could not appear before the respondent police on that day, due to heavy rain. Hence, on 7.12.2015, this Court again directed the petitioner to appear before the respondent police on 18.12.2015 at 10.30 a.m. with requisite documents.

6. Today, when the matter came up for hearing before this court, learned counsel for the petitioner submitted that the petitioner appeared before the respondent police on 18.12.2015 and produced all the required records and documents and on production of such documents, the respondent police directed the petitioner to appear before them as and when required .

7. Heard the learned Additional Public Prosecutor.

8. Since, already the petitioner has produced all the required documents before the respondent police, there is no need to pass any further order in this petition. Hence recording the submission of learned counsel for petitioner, this Criminal Original Petition is closed. Consequently, connected M.P.No.1 of 2015 is closed.
