ORDER
When the matter was taken up for hearing today, the affidavit of the Executive officer of the Temple was filed and the relevant portion is extracted hereunder:- "15). I humbly submit that in so far as the eviction order passed as against the said 103 occupants, it was decided to evict them on 7.11.2025 as per Section 78 and 79 of the Act. In the situation the remaining 32 occupants gave letters to the temple to treat them as Tenants and agreed to pay the fair rent fixed by the temple. More over the occupants who filed Revision petitions before the Commissioner HR&CE department and those who filed writ Petitions also gave letters to the temple to treat them as Tenants and agreed to pay the fair rent fixed by the temple over their respective occupation. As such all 103 occupants gave letters to the temple requesting to treat them as tenants which are under consideration. Based on which the Temple and HR&CE Department have sent letter dated 20.01.2026 to the concerned District Registrar office to ascertain the present market value and
guideline value of the property in respect of the said Survey numbers to fix fair rent to the said 103 occupants. After getting the detail of the market value from the concerned registrar office, fair rent will be fixed following Section 34 of the Act and the Joint Commissioner and Commissioner, HR&CE department will pass appropriate orders to accept and regularize the occupants as tenants of the temple."
2. In the light of the above-decision taken by the HR & CE Department, no furthers are required to be passed in this Contempt Petition. Accordingly, this Contempt Petition is closed.
