Writ Petition , filed under Article 226 of the Constitution of India, for issuance of Writ of Mandamus, directing the first respondent to forthwith take appropriate steps to declare Pochampalli Panchayat Union within the stipulated time in accordance with Section 15 (3) of Tamil Nadu Panchayats Act, 1994 as all the procedural formalities had already been completed under Section 15 (1) and (2) of Tamil Nadu Panchayats Act, 1994.

(Order of the Court was delivered by T.S.Sivagnanam, J.,) Heard Mr.K.Raja, the learned counsel appearing for the petitioner and Mr.T.N.Rajagopalan, the learned Government Pleader (I/c) appearing for the respondents.

This Writ Petition has been filed as Public Interest Litigation, seeking for a direction upon the first respondent to forthwith take appropriate steps to declare Pochampalli Panchayat Union within the stipulated time in accordance with Section 15 (3) of Tamil Nadu Panchayats Act, 1994 as all the procedural formalities had already been completed under Section 15 (1) and (2) of Tamil Nadu Panchayats Act, 1994. The learned Government Pleader, in charge, appearing for the respondents has produced the written instructions given by the Director of Rural Development, vide his letter, dated 08.12.2017, from which, it is seen that the proposal regarding bifurcation of three Panchayat Unions, viz., Kaveripattinam, Bargur and Mathur is under active consideration of the Government, and orders would be issued at appropriate time.

4. Since the matter is pending from 2014, in the fitness of things, early decision should be taken by the Government. Accordingly, this Writ Petition is disposed, by directing the first respondent to take appropriate decision on the proposal, which is pending before the Government with regard to bifurcation of the three Panchayat Unions, viz., Kaveripattinam, Bargur and Mathur, as expeditiously as possible, preferably, within a period of four months from the date of receipt of a copy of this order. No costs.
