O R D E R
This writ petition has been filed for issue of a writ of mandamus directing the respondent to act upon the online applications submitted by the petitioner on 04.03.2025 and 06.03.2025 and to conduct survey in the subject property and for demarcation of boundaries.
2. Heard the learned counsel for the petitioner, the learned Special Government Pleader for the respondents 1 to 3 and Mr.V.J.Priyadarsana, learned Government Advocate for the fourth respondent.
3. The petitioner is placing reliance upon various sale deeds that were executed during the period from 12.02.2023 to 18.08.2023. The petitioner is also placing reliance upon the joint patta issued in Patta Nos.2458, 2410, 2459, 2414, 2415, 2412, 2411 and 2457. The petitioner submitted two online applications on 04.03.2025 and 06.03.2025 in order to survey nearly 11 survey numbers by paying necessary charges. Since the same was not acted upon, the present writ petition came to be filed before this Court.
4. Taking into consideration the facts and circumstance of the case and considering the materials placed before this Court, there shall be 3/6
a direction to the first respondent to act upon the online applications submitted by the petitioner on 04.03.2025 and 06.03.2025 and conduct survey in the subject property based on the title documents relied upon by the petitioner and also the joint patta that stands in the name of the petitioner and other co-owners. This process shall be completed within a period of four weeks from the date of receipt of a copy of this order. If there are any other interested parties, such survey shall be conducted in their presence. If the first respondent requires any police protection, the same shall be provided by the fourth respondent. The Writ Petition is disposed of in the above terms. There shall be no order as to costs.
