3. Notice has been served on second respondent and affidavit of service has also been filed. The name of the second respondent has also been printed in the cause list. However, there is no representation on behalf of the second respondent either in person or through a pleader.

4. Heard learned counsel for the appellant and perused the records.

5. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, this miscellaneous petition is allowed and the delay of 162 days in paying the deficit court fee is condoned.
