The petitioners, who were arrested and remanded to judicial custody on 04.04.2023 for the offences punishable under Sections 341, 397, 294(b) & 506(i) of IPC and Section 4 of TNPHW Act in crime No.81 of 2023 on the file of the respondent police, seek bail.

2. The case of the prosecution is that on 02.04.2023, petitioners waylaid the de-facto complainant, attacked her with knife and robbed her cellphone. Hence the complaint.

3. The learned counsel appearing for the petitioners submitted that false case has been foisted as against the petitioners and they have not committed any offence as alleged by the prosecution. Hence, he prays to grant bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the petitioners waylaid the de-facto complainant, attacked her with knife and robbed her cellphone. There are three and four previous cases pending against the 1st and 2nd petitioner respectively. He further submitted that already there is a proposal for detaining the petitioners under the Goondas Act. 5. It is seen that the petitioners are habitual offenders and they were arrested only on 04.04.2023. Taking consideration of the above facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners.
