ORDER

The petitioner, who was arrested and remanded to judicial custody on 09.03.2026 for the alleged offences under Sections 342, 376(2)(1) and under Section 376(2)(n) of Indian Penal Code, 1860, in Crime No.1 of 2019 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the case was pending before the Sessions Judge, Magalir Needhi Mandram (Fast Track Mahila Court),

Villupuram. The petitioner/accused was absent and hence NBW was issued on 09.07.2025. In pursuance of the same, he was arrested on 09.03.2026 and remanded to judicial custody.

The learned counsel appearing for the petitioner submitted that NBW was issued on 09.07.2025 and the petitioner was arrested and remanded to judicial custody on 09.03.2026 and he has been in incarceration since then. It is further submitted that the petitioner is innocent and has been falsely implicated in this case. The learned counsel would submit that the petitioner belongs to a respectable family and he will not abscond or tamper with witnesses. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that this is the third time, the petitioner absconded and NBW was issued on 09.07.2025. It is further submitted that the trial is in advanced stage and if the petitioner is enlarged on bail, the same would jeopardise the prosecution case. Hence, he opposed to grant bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

Considering the submission of the learned counsel on either side and considering the totality of the circumstances and the fact that the petitioner absconded repeatedly and NBW was issued for the third time and also considering the advanced stage of trial, as rightly contended by the learned Government Advocate, if the petitioner is enlarged on bail, the same would affect the trial. Hence, this Court is not inclined to grant bail to the petitioner.
