ORDER

The petitioner has filed this petition praying to call for the records pertaining to the proceedings in C.C.No.2916 of 2022 on the file of the Judicial Magistrate-IV, Coimbatore and quash the same.

2. Learned counsel for the petitioner submitted that the offences alleged are compoundable offences and that the parties have settled the matter between themselves.

3. However, on a reading of the complaint, FIR, charge-sheet and the statement of witnesses, it is clear that there are prima-facie materials against the petitioner to proceed with the case further. The grounds taken by the petitioner, are the defence, which can be agitated only during the course of trial.

4. There are no merits in this petition and the same is dismissed. This Court is not inclined to quash the said C.C.No.2916 of 2022. However, the petitioner is at liberty to work out his remedy before the trial Court in accordance with law.

The miscellaneous petitions are closed.
