ORDER
The present writ petition is filed praying for a writ of Mandamus to direct the 2nd respondent to fix the compensation at the rate of Rs.420.10/- per sq.mt. for 188 Sq.mts. in S.No.513/3A and 219 Sq.mts. in S.No.513/7 acquired by 2nd respondent in Award No.134/2019-20 dated 04.12.2020 by considering petitioner's representation dated 10.01.2025.
2.It is submitted by the learned counsel for the petitioner that the petitioner submitted a representation dated 10.01.2025 for fixation of compensation at the rate of Rs.420.10/- per sq.mt. for 188 Sq.mts. in S.No.513/3A and at Rs.219/- per Sq.mt. in S.No.513/7. However, the said representation has not been considered so far by the 2nd respondent. Aggrieved by the same, the petitioner has come before this Court. Hence, the writ petition.
3.At the outset, it is submitted by the learned Special Government Pleader for respondents that the representation dated 10.01.2025 made by the petitioner would be considered and appropriate orders would be passed keeping in view provisions of National Highways Act in 2/5
particular Section 20 and also Section 28A of Land Acquisition Act, within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner.
4.In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to 2nd respondent to consider the representation dated 10.01.2025, on its own merits and pass appropriate orders in accordance with law, keeping in view provisions of National Highways Act in particular Section 20 and also Section 28A of Land Acquisition Act, after affording reasonable opportunity of hearing to the petitioner and any other interested persons/stake holders, within a period of eight (8) weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law. No Costs.
