Respondent(s) PRAYER Transfer Civil Miscellaneous Petition filed under Section 22 of Code of Civil Procedure, prays to withdraw the suit in HMOP.No.142 of 2025 pending on the file of the Subordinate Court, Ambattur and to transfer the same to the Family Court at Chennai.

For Petitioner(s):

MR.T.Sundaravadanam For Respondent(s):

ORDER

The learned counsel for the petitioner submitted that the petitioner seeks transfer of the case from the Subordinate Court, Ambattur, to the Family Court, Chennai. Admittedly, both parties are residing in Chennai. Since all the hearings

are being conducted at Chennai and the petitioner is also residing there, the reason stated for seeking transfer is not acceptable.

2. Further, the Family Court, Chennai, is already burdened with a large number of cases. Therefore, the learned trial Judge is directed to issue notice to both parties and dispose of the case as expeditiously as possible.

3. However, considering that the petitioner is having a three-year-old child, her personal appearance before the Court is dispensed with, except as and when her presence is specifically required.

4. In view of the above, this Transfer Civil Miscellaneous petition is disposed of. Consequently, the connected miscellaneous petition is closed. No costs.
