O R D E R

This petition has been filed seeking a direction to the respondent police to register a case based on the complaint of the petitioner dated 13.11.2015.

2.It is seen that the petitioner is doing Cargo Parcel Business in the name and style of Om Sai Cargo. On 31.10.2015, one Ansari approached the petitioner and requested him to send 35 parcels to Delhi from Chennai. Since the said Ansari had business transaction with the petitioner for the past 3 years, the petitioner booked the parcels along with necessary papers. In the meanwhile, the said Ansari dropped his parcels to the petitioner transit agent namely, Sony Cargo Movers in Egmore Railway Station through petitioner employee one Ajay and the same was acknowledged by one Purushothaman, who was an employee of Sony Cargo Movers. On 2.11.2015, the said Purushothaman from Sony Cargo Movers communicated the petitioner that some of the parcels were missing and the same was intimated to the said https://hcservices.ecourts.gov.in/hcservices/

Ansari and hence, the petitioner gave a complaint before the Railway Police Station. The above said fact was intimated to one Papu Bai, who is a concerned person to receive the parcels through the instructions from the said Ansari. Hence, the above said Ansari, Papu Bai along with one Raja Mohamed lodged a complaint against the petitioner and the said Purushothaman before Thenampet Police Station. When they approached the Thenampet police station, the police officials advised them to approach the Railway Police station. Subsequently, the above said persons became angry with the petitioner and threatened him with dire consequences. Hence, the petitioner lodged a complaint on 13.11.2015 before the respondent police. On receipt of the same, C.S.R.No.671 of 2015 has been assigned by the respondent police. Thereafter no action has been taken by the respondent police till date. Hence, the petitioner has filed the present criminal original petition.

3.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent and also perused the materials available on record.

4.Considering the submissions made on either side, this Court is of the opinion that the respondent is directed to enquire into the matter based on the complaint of the petitioner dated 13.11.2015, since already CSR number has been assigned and dispose of the same in accordance with law, as early as possible.

5.With the above direction, this petition is disposed of.
