Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorari to call for records of the respondent herein leading to issuance of Impugned Order dated 23.03.2024 (vide DIN : ITBA/AST/S/143(3)/2023-24/1063275778(1)) and to quash the same.

Order Reference may be made to the order passed by this Court on the last hearing, i.e. on 16.06.2025:- which is extracted as under:- ''Mr.S.Sathyanarayanan, the learned counsel submits that he is no longer appearing for the petitioner in this Writ Petition, and he has returned all the papers related to this Writ Petition to the petitioner, and therefore, requested this Court to delete his name.

2. In view of the above, Registry is directed to find out whether any other counsel has entered appearance on behalf of the petitioner, and if so, print the name of the counsel or else, print the name of the petitioner itself in the cause list and post the case on 26.06.2025, on which date, the matter will be decided on merits.''

2. Thus, as per the aforesaid direction, the matter is listed today, and when the same is taken up, though the name of the petitioner is printed in the causelist, the petitioner has neither appeared in person before this Court nor is represented by any other counsel, newly engaged by them, whereas, a learned counsel representing the erstwhile counsel on record appeared before this Court to pursue with the matter, which cannot be 2/4

permitted, inasmuch as, the erstwhile learned counsel, viz., Mr.S.Sathyanarayanan, stated before this Court on the last occasion, i.e. on 16.06.2025 that he was no longer appearing for the petitioner in this Writ Petition and has also returned all the papers related to this Writ Petition to the petitioner.

3. Hence, this Writ Petition is dismissed for non-prosecution. No costs.
