Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, to direct the first respondent to dispose the representation made on 07.07.2017 by the petitioner.

O R D E R

Mr.R.Senthilvel, learned Government Advocate takes notice for the first respondent. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. The petitioner seeks for a mandamus directing the first respondent to dispose of his representation dated 07.07.2017 wherein and whereby she sought for police protection to erect cell phone tower at her premises.

3. The learned Government Advocate appearing for the first respondent, based on instructions, submitted that the neighbours of the petitioner have made objections for erecting such tower on the apprehension of the possible radiation problem and therefore, after enquiring both the parties, the petitioner's compliant has already been closed, by directing the respective parties to approach the Civil Court.

4. When such being the factual position, I do not think that the present writ petition can be maintained by the petitioner without resorting to the other remedies available in view of the closure of his complaint. Therefore, this writ petition is closed, however, by granting liberty to the petitioner to agitate the matter before the appropriate forum by filing appropriate proceedings. No costs.
