ORDER

This Criminal Original Petition has been filed seeking a direction to the respondents 1 and 2 not to harass the petitioners under the guise of enquiry.

2. The case of the prosecution is that the petitioner is required in connection with an enquiry in C.No.2505 of 2026. It is alleged that the petitioner and the third respondent are having business rivalry and that the petitioner along with goons, forcibly entered the third respondent business premises, attempted to evict him and caused damage to the property.

3. Per contra, the learned counsel for the petitioner stoutly denied the above allegations and submitted that the petitioner and the third respondent are having business dispute and an arbitration proceedings is pending. Hence, a false complaint has been lodged.

4. Considering the above submissions and upon perusal of records, this Court finds that there exists a business dispute between the parties, for which, employing goons and trespassing the property and causing damage cannot be permitted. The petitioner is directed to appear before the second respondent Police on 27.04.2026 and offer his explanation along with supporting documents if any. Upon such enquiry, if the respondent Police finds any offence against the petitioner, they are at liberty to proceed in accordance with law.
