The petitioners, who were arrested and remanded to judicial custody on 20.04.2022 at the hands of the respondent police for the offences punishable under Sections 8(c), 22(b), 29(1) of NDPS Act, 1985 on the file of the respondent Police, seek bail.

2. The case of the prosecution is that when the respondent Police and their team went on secret search, they found that the petitioner and other accused were in possession of banned drugs. Hence the complaint.

3. The learned counsel for the petitioner would submit that the petitioners are arrayed as A1 and A2. They were taken by the respondent police on 18.04.2022 itself. Immediately, the parents of the petitioners are lodged a complaint in fact by till stand in the name of Mappedu Police Station. Therefore, a false case has been foisted against the petitioners. Hence, he prays for bail to the petitioners.

4. The learned Additional Public Prosecutor would submit that there are totally 3 accused, in which the petitioners are arrayed as A1 and A2. The total contraband involved in this case are LSD stamps - 30 Nos, MDMA Tablets 30 Nos, which are of commercial quantities. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. That apart, the grounds raised by the petitioners cannot be considered and it is to be proved before the Trial Court during the evidence. Therefore, the petitioners failed to satisfy the twin conditions as contemplated under Section 37 of the NDPS Act, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 20.06.2022 Lpp 2/3
