O R D E R

It is submitted by the learned Additional Public Prosecutor, representing the respondent/Police that the subject matter of the Vehicle, viz. Lorry, was under hire purchase in favour of Kotak Mahindra Bank Ltd., and since the petitioner failed to pay the dues, the Financier, who is the owner of the Lorry, confiscated the Vehicle.

Considering the fact the Vehicle is under hypothecation, and the Financier seized the Vehicle on account of non-payment of dues by the petitioner, I am of the view that there is no need to pass any order, as no criminal offence is made out. Accordingly, the Criminal Original Petition is dismissed.
