ORDER

Petitioners seek transfer of M.C.No.294 of 2010 on the file of III Additional Family Court, Chennai to the file of Judicial Magistrate Court, Nagercoil.

2. Learned counsel for the petitioners submits that the first petitioner moved M.C.No.294 of 2010 on the file of III Additional Family Court, Chennai seeking maintenance for herself and on behalf of her minor children. She has no means for subsistence and she is now at Kanyakumari under the care of her parents and hence, she seeks transfer of M.C.No.294 of 2010 from the file of III Additional Family Court, Chennai to the Court of the Judicial Magistrate, Nagercoil.

3. Though the name of respondent is printed in the cause list, there is no representation for respondent. Heard learned counsel for petitioner.

4. Considering the facts and circumstances of the case, this Court transfers the case in M.C.No.294 of 2010 on the file of III Additional Family Court, Chennai to the file of learned Judicial Magistrate, Nagercoil, who shall dispose of the case as expeditiously as possible.

5. The Criminal Original Petition is disposed of with the above direction. Connected miscellaneous petition is closed.
