(CR.NO.96 OF 2016) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) Modify the condition of surety of blood relative imposed by this Hon'ble court in Crl.MP.No.16607 of 2019 in Crl.A.No.774 of 2019 dated 21.01.2021 and pass such further or other orders. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.T.SARAVANAN, Advocate for the Petitioner, and of MR.R.MUNIYAPPARAJ, Govt. Advocate (Crl. Side) on behalf of the Respondent, the court made the following order:- (Order of the Court was made by P.N.PRAKASH,J.) This petition has been filed to modify the condition of surety of blood relative imposed by this Court vide order dated 21.01.2021 passed in Crl.M.P.No.16607 of 2019 in Crl.A.No.774 of 2019. 2.
This Court, by order dated 21.01.2021 in Crl.M.P.No.16607 of 2019 in Crl.A.No.774 of 2019, granted suspension of sentence and bail
to the petitioner on certain conditions, one of which is that, "9(i) The petitioner shall execute a bond for a sum of Rs.25,000/- with two sureties, of whom, one should be a blood relative, each for a like sum to the satisfaction of the Judicial Magistrate Court, Ambattur". 3.
This petition has been filed for modification of the aforesaid condition on the ground that the petitioner does not have any blood relative, inasmuch as, the complainant in this case is none other than his wife as he is said to have committed the murder of his father-in-law. It is the grievance of the petitioner that no relative is coming forward to stand surety for him.
In view of the above, this criminal miscellaneous petition stands allowed and the aforesaid condition is modified to that effect that, "the petitioner shall execute a bond for a sum of Rs.25,000/-, with two solvent sureties, each for a like sum to the satisfaction of the II Additional District Court, Poonamallee". The rest of the conditions shall remain the same.
