ORDER

The petitioner, who was arrested and remanded to judicial custody on 26.02.2026 for the alleged offence under Sections 191(2), 191(3), 296(b), 127(2), 115(2), 118(1), 109 and 351(3) of BNS, 2023 (147, 148, 294(b), 342, 323, 324, 307, 506(ii) of IPC) in Crime No.83 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner, along with other accused persons, attempted to murder the defacto complainant's husband. In furtherance thereof, he sustained serious injuries. Hence, the present case has been registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and that he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner has been in judicial custody since 26.02.2026 and he is ready to co-operate with the investigation and abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

Per contra, the learned Government Advocate (Criminal Side) appearing for the respondent Police reiterated the prosecution and submitted that there are 11 accused in this case and there is a specific overt act against the petitioner and the defacto complainant's husband sustained serious injuries in his head and he was admitted as an inpatient in the hospital for a period of more than 30 days. He further submitted that the co-accused bail application also dismissed by this Court. Hence, he opposed the grant of bail to the petitioner.

5. In such view of the factual position, it is not an appropriate time to consider this bail application.
