ORDER

The respondent herein had earlier filed Crl.O.P.No.33823 of 2025 seeking for a direction to the petitioner herein for completion of the investigation and to 1/4

file the final report in Crime No.231 of 2023. This Court vide order dated 12.12.2025 has granted two months time to complete the investigation and to file the final report and now the present petition has been filed by the prosecution seeking further extension of time by six months. 2.The learned Additional Public Prosecutor for the petitioner police has submitted that initially a case under section 174 of Cr.P.C has been registered based on the complaint given by one Ms.Mariya Jayasri complaining that her brother Mr.Suresh was staying in a hut and there was a fire accident in which he died. During the investigation, it was found that the said Suresh was alive and the person who died was one Dillibabu and therefore, the case was altered to sections 302 and 201 IPC and the investigation is in progress.

Since the dead body was burnt beyond recognition, the same was sent for scientific examination and thereafter, the DNA test was conducted and since there were inconsistencies in the scientific examination, a request has been made to reexamine the DNA samples to ascertain the identity of the deceased. Therefore, the learned Additional Public Prosecutor requested for extension of time. 3.In the light of the above submissions and on perusing the materials available on record, this court is of the considered view that the investigating officer shall be granted further time to complete the investigation and to file the final report.
