ORDER

This petition has been filed to direct the respondent not to harass the petitioner based on the complaint given by one Latha.

2. The learned counsel for the petitioner has submitted that one Latha, wife of Kumar has lodged a complaint on 26.08.2018 against the petitioner, alleging that the petitioner is her husband and he is refusing to live with her. He further submitted that the said Latha married to one Kumar and she is having three children out of Wedlock with Kumar and she is aged about 35 years. He further submitted that the petitioner is not having any relationship with said Latha and the fact remains so, based on the complaint given by the said Latha, the respondent is unnecessarily harassing the petitioner.

3. The learned Additional Public Prosecutor has submitted that the said Latha has lodged a complaint stating that she got divorce from her former husband and living with the petitioner https://hcservices.ecourts.gov.in/hcservices/

and subsequently the petitioner deserted her and the said complaint is still pending for enquiry.

4. Considering the aforesaid submissions, the respondent is directed to enquire the said complaint and if the enquiry reveals any cognizable offence, he has to register a case and proceed in accordance with law. Instead of doing so, she should not unnecessarily harass the petitioner.

5. With the aforesaid observations, the petition is disposed of.
