ORDER

This Criminal Original Petition has been filed to direct the 1st and 2nd respondent police not to harass the petitioner in connection with the offence under Section 420 of IPC.

2. The learned Senior counsel appearing for the petitioner submitted that the petitioner is neither a complainant nor an accused. He further submitted that he has been unnecessarily harassed to give a complaint.

3. Mr.A.Gokulakrishnan, learned Additional Public Prosecutor appearing for the respondents would submit that the respondent police are not harassing the petitioner since he is not arrayed as an accused.

4.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

5. In such view of the matter, since the petitioner is neither a complainant nor an accused, the respondent police cannot repeatedly ask the petitioner to come to the police station. If the police is inclined to record the statement, let them record the statement in their place itself.
