Respondent PRAYER: Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorarified Mandamus calling for the records relating to the proceedings of the respondent in Procs.No.C4/4674/2021, dated 23.12.2021 and quash the same as illegal, incompetent, and ultravires and consequently, direct the respondent to issue Class II legal heirship certificate for the petitioner's deceased brother namely Mr.C.Karuppaiyan died on 05.06.2021.

ORDER

The Writ Petition has been filed in the nature of a Certiorarified Mandamus seeking interference with the proceedings of the respondent / Tahsildar, Egmore, Chennai - 600 031, in proceedings No. C4/4674/2021, dated 23.12.2021.

The petitioner had applied for Class II legal heirship with respect to his brother C.Karuppaiyan, who died on 05.06.2021. The respondent had rejected the said application and had refused to grant legal heirship certificate.

M/s. P.Rajarajeswari, learned Government Advocate, had taken notice on behalf of the respondent and stated that the petitioner can give an application afresh consequent to the circular, which had been issued by the Government in G.O.Ms.No. 478 dated 29.09.2022. 4.

Let the petitioner make a fresh application through online to the respondent. If the said application is filed, the respondent may invite the petitioner for personal hearing and enquire with him and then take a decision. After the application is received by the respondent, necessary orders are to be passed within a period of 8 weeks thereafter.

With the above direction, the Writ Petition stands disposed of. No costs.
