ORDER

(Made by Dr.Anita Sumanth J.) This habeas corpus petition has been filed by a 45 years old male seeking production of his wife, aged 34 years and his daughter aged 4 years.

2. None appears for the petitioner today when the matter is called. However, the learned counsel for Government of Tamil Nadu (Criminal Side) states that the authorities have secured the wife of the petitioner /(Dhurgadevi) (detenue), and she is present in Court. The detenue states that her husband had during the pendency of this petition, approached her and she has handed over her daughter to him. Shamuktha, aged 4 years, daughter of the petitioner and the detenue, is hence presently with the petitioner.

3. We are unable to ascertain this position as the neither petitioner nor his counsel are present in Court today and are recording the aforesaid submission as one made by the detenue.

4. Recording the aforesaid, this habeas corpus petition is closed. It is for the petitioner and the detenue to workout their marital differences before the appropriate forum and also take a concerted decision relating to custody of the child. No costs.
