Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, praying to direct the Inspector of Police (Law and Order), S15, Selaiyur Police Station, Chennai 600 073 to register FIR on the complaint dated 19.11.2015 of the petitioner and investigate and to file a final report before the competent Court.

ORDER

This petition is filed for a direction to the respondent to register a First Information Report on the complaint dated 19.11.2015 given by the petitioner.

2. The case of the petitioner is that one Esakimuthu is running a Real Estate Office under the name and style of name of Balaji Real Estate and he is working in his office. On 19.11.2015 at about 4.15 p.m. one Murugan and three others have entered into the said office armed with deadly weapons and abused him in filthy language and threatened him and also caused damaged to the articles. When the neighbor came to rescue, they ran away and went to the said Esakimuthu's house and threatened him that they would murder him. Therefore, he https://hcservices.ecourts.gov.in/hcservices/

lodged a complaint to the respondent police on 19.11.2015 but, no action has been taken so far. Hence, the petitioner has come forward with this petition.

When the matter was taken up for consideration today, the learned Additional Public Prosecutor submitted that the complaint was given only through post and if a fresh complaint is given by person, appropriate action would be taken. 4.

I have heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor. 5.

In view of the submissions made by the learned Additional Public Prosecutor, this Court directs the petitioner to give a fresh complaint to the respondent along with a copy of this order within a period of one week from the date of receipt of a copy of this order and on receipt of the same, the respondent is directed to conduct enquiry on the same and upon enquiry and if materials are gathered indicating commission of any cognizable offence, is directed to proceed further in accordance with law, as early as possible.

With the above directions, the Criminal Original Petition is disposed of.
