(CRIME NO.31/2020) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the order dated 19.04.2021 passed in Crl.M.P.No.4801/2021 in Crl.O.P.No.17598/2020 dated 18.11.2020 in pending Crime No.31/2020 on the file of the respondent police and thus render justice Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S R.RAMESH, Advocate for the Petitioner and of MR.C.E.PRATAP, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- (The case has been heard through video conference) This Miscellaneous Petition has been filed by the petitioner to modify the order dated 19.04.2021 passed in Crl.MP.No.4801 of 2021 in Crl.OP.No.17598 of 2020 dated 18.11.2020 in pending Crime No.31/2020 on the file of the respondent police.
2. This Court by its order dated 24.02.2021, issued a direction to the petitioner to deposit a sum of Rs.1,00,000/- to the credit of Crime No.31 of 2020 in Crl.MP.No.1994 of 2021 in Crl.OP.17589 of
2020. However, the said amount was not deposited within the period prescribed by this Court. Hence, the petitioner has filed a petition seeking for time extension before this Court in Crl.MP.No.4801 of 2021. This Court vide order dated 19.04.2021, further extended time by a period of two weeks from the date of receipt of a copy of the order. Thereafter, in order to comply with the said condition, the petitioner has surrendered before the trial court and filed a memo along with cash for Rs.1,00,000/-. But, the trial court has declined to receive the amount of Rs.1,00,000/- on the ground that the amount was not specifically mentioned in the order. Due to which, the petitioner has filed the present modification petition.
3. The learned counsel for the petitioner has submitted that this court may permit the petitioner to deposit a sum of Rs.1,00,000/- as ordered by this court in Crl.MP.No.1994 of 2021 in Crl.OP.17589 of 2020 dated 24.02.2021.
4. Considering the facts and circumstances of the case and the submissions made by the learned counsel, this Court is inclined to extend the time for a period of two weeks and the petitioner is directed to deposit a sum of Rs.1,00,000/- to the credit of Crime No.31 of 2020 in Crl.OP.17589 of 2020 within a period of two weeks from the date of receipt of a copy of this order. -sd/- 03/08/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
