Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of certiorarified mandamus calling for the records of the respondent in connection with the impugned order passed by him in No.Estt./C1/4/12310/2015 dated 01.06.2015 and quash the same and direct the respondent to reinstate the petitioner into service and grant him all consequential service and monetary benefits.

ORDER

The relief sought in this Writ Petition is to quash the Proceedings dated 01.06.2015 bearing No.Estt./C1/4/12310/2015 issued by the Respondent and to direct the Respondent to reinstate the Petitioner into service and grant him all consequential service and monetary benefits. 1/5

2. Today, when this Writ Petition was taken up for hearing, none appeared on behalf of the Petitioner.

3. The learned Standing Counsel for the Respondent submitted that the Petitioner is one of the accused in a murder case registered in Crime No.1 of 2015 on the file of CBCID, Salem and was arrested by the CBCID, Salem on 27.03.2015. Hence, the Respondent suspended the Petitioner from service with effect from 27.03.2025 vide Impugned Proceedings dated 01.06.2015.

3.1. It is further submitted by the learned Standing Counsel for the Respondent that since the Respondent University was taken over by the Government of Tamil Nadu in the year 2013 and now, it acts as a State Government University, the conditions of service specified in the Tamil Nadu Civil Services (Discipline and Appeal) Rules, 1955 will apply to all the staffs of the Respondent University.

3.2. The learned Standing Counsel also submitted that the Impugned Proceedings issued by the Respondent is in accordance with the Tamil Nadu 2/5

Civil Services (Discipline and Appeal) Rules, 1955 and the same does not warrant any interference.

4. Heard the learned Standing Counsel for the Respondent and perused the materials available on record.

5. In view of the above submissions made by the learned Standing Counsel for the Respondent, this Writ Petition is dismissed. However, it is made clear that the Respondent shall reinstate the Petitioner in service, if the criminal proceedings in Crime No.1 of 2015 on the file of CBCID, Salem pending against the Petitioner are dropped. No costs. Consequently, connected Miscellaneous Petitions are closed. 30.04.2025 mrr Index : Yes/No Speaking Order (or) Non-Speaking Order 3/5
