[RESPONDENTS] Prayer :-Petition filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus to direct the respondents 2 and 3 to take appropriate action against the respondents 4 and 5 for their illegalities under the Provisions of Tamil Nadu Co-Operative Societies Act 1983 based on the representations of the petitioner dated 29.06.2015 and 09.07.2015 respectively within stipulated time.

After some arguments, the learned counsel appearing for the petitioner submitted that the authority has taken action and passed an order on 09.09.2015, however his grievance is that the order is yet to be implemented.

2.In the light of the above, the prayer sought for taking action on the representation has become infructuous and therefore the learned counsel for the petitioner seeks permission of this Court to withdraw the Writ Petition, with liberty to move the authorities, if he has got any grievance in not implementing the order dated 09.09.2015.

3.The learned counsel appearing for the fifth respondent submitted that as against the order dated 09.09.2015, the fifth respondent has given his objection on 14.09.2015 and sought permission to approach the authority and deal with the matter in the manner known to law. Permission is granted accordingly. 4.Accordingly, Writ Petition is dismissed as withdrawn, with liberty as prayed for. No costs.

Consequently, connected Miscellaneous Petition is closed.
