CMP.No.11396 of 2021 has been filed by the Petitioner/Appellant Insurance Company seeking permission of this Court to receive the following documents as additional documents, namely, (a) Copy of Accident Register dated 06.09.2009; (b) M.V.Inspection Report of the claimant vehicle TN 58 F 6613 dated 8.9.2003; (c) M.V.Inspection Report of insured Car TN - 581 dated 22.12.2003; (d) Private investigation report dated 20.11.2010; (e) Copy of complaint to CBCID dated 22.12.2010; (f) Order in Cr.O.P.No.9229 of 2016 and (g) Copy of FIR dated 28.08.2021.

2. According to the Petitioner/Appellant, a car bearing registration No.TNU-0581 insured with the Appellant Insurance Company was never involved in the accident which resulted in the first respondent sustaining injuries. According to the Petitioner/Appellant, they have received an investigation report dated 20.11.2010 and as per the said report, the insured car bearing registration No.TNU-0581 was never involved in the accident which is the subject matter of MCOP.No.4782 of 2004 on the file of the II Court of Small Causes, Chennai which was earlier on the file of the Ist Additional District Judge, Fast Track Court No.I. In order to substantiate their case, they are seeking for marking of the aforementioned documents as exhibits.

3. This Court is satisfied with the reasons stated in the affidavit filed in support of this petition.

4. The respondents have been duly served and their names have also been printed in the causelist today.

5. For the foregoing reasons, this civil miscellaneous petition is allowed as prayed for and the following documents namely, (a) Copy of Accident Register dated 06.09.2009; (b) M.V.Inspection Report of the claimant vehicle TN 58 F 6613 dated 8.9.2003; (c) M.V.Inspection Report of insured Car TN - 581 dated 22.12.2003; (d) Private investigation report dated 20.11.2010; (e) Copy of complaint to CBCID dated 22.12.2010; (f) Order in Cr.O.P.No.9229 of 2016 and (g) Copy of FIR dated 28.08.2021 are marked as Ex.D1 to Ex.D7.
