ORDER

This Civil Revision Petition has been filed seeking order directing the Sub Court, Tiruvarur to number the application to its file filed by petitioner on 25.03.2025 in E.A.Sr.No.2051/2025 in E.P No. 14 of 2023 in I.A.No. 2 of 2020 in H.M.O.P. No. 2740 of 2020.

2. The petitioner herein filed E.A. Sr. No. 2051 of 2025 in E.P. No. 14 of 2023 in I.A. No. 2 of 2020 in H.M.O.P. No. 2740 of 2020 on the file of the Sub Court, Tiruvarur, seeking to terminate E.P. No. 14 of 2023. The petitioner contends that the list of articles relied upon by the decree-holder in the execution petition for the return of articles was obtained through a fraudulent document. To substantiate this claim, the petitioner obtained a certificate from a private forensic expert at the Truth Foundation, which certifies that the signature found on the list of articles differs significantly from the standard signatures. Based on this expert opinion, the petitioner filed the application praying to terminate E.P. No. 14 of 2023; however, the trial court refused to take the application on file. Aggrieved by the same, the petitioner has preferred this Civil Revision Petition

3. Perused the records. The petitioner has enclosed the report given by the private forensic expert, who has certified that the signature found on the alleged list of articles relied upon by the respondent is not authentic. Therefore, the Sub Court, Tiruvarur, is directed to take E.A. Sr. No. 2051 of 2025 in E.P. No. 14 of

2023 in I.A. No. 2 of 2020 in H.M.O.P. No. 2740 of 2020 on file within a period of one week from the date of receipt of a copy of this order, and to dispose of the same within a period of one week thereafter.

4. Accordingly, this Civil Revision Petition is allowed. No Costs. Pending petition, if any, is closed.
