PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the third respondent to register a case based on the complaint of the petitioner dated 19.04.2021 and file a FIR.

ORDER

This petition has been filed to direct the third respondent to register a case based on the complaint of the petitioner dated 19.04.2021 and file a FIR.

2. The petitioner is a lady and she had sent a complaint to the third respondent police/Inspector of Police, J8, Neelankarai Police Station, by registered post on 20.04.2021, but no action has been taken. In the complaint, she had mentioned that one Swaminathan, his wife Lakshmi and their son Kannan had joined in the chit conduced by the petitioner.

Thereafter, they taken the chit amount, but they failed to repay the monthly chit amount and now they have to pay a sum of Rs.25 lakhs. They belong to a Fishing Community and as per the Community, the panchayat was held, wherein they agreed to repay the entire amount, but they failed to do so. Hence, she has lodged a complaint.

3. The learned Government Advocate (Crl.Side) has submitted that except the postal receipt, nothing produced to prove that the complaint has reached the Inspector of Police. Further, there is no proof of the complaint has been filed. If the petitioner desires to lodge a complaint, the second respondent police shall entertain the complaint and thereafter enquiry will be conducted.

4. At this stage, the learned counsel for the petitioner has submitted that the petitioner will appear before the respondent police on 02.08.2021 and furnish the copy of the complaint.

5. In view of the same, the respondent police is directed to consider the complaint of the petitioner and dispose of the same in accordance with law.

6. With the above directions, this Criminal Original Petition is disposed of.
