(CR NO.27 OF 2022) For Petitioner : M/S.M.IDHAYAMARY Advocate For Respondent : MR.A.DAMODARAN, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 406 and 420 of I.P.C, in Crime No.27 of 2022, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner and other accused have ordered three items of Laptops through online. After receipt of the electronic goods, they returned old Laptops as if they received damaged Laptops and thereby, they have cheated the defacto complainant. Hence, the complaint.
3. It is seen from the records that this is the second anticipatory bail petition filed by the petitioner. The earlier petition filed by the petitioner in Crl.O.P.No.11362 of 2022 was dismissed on 18.05.2022. He would further submit that the petitioner has been falsely implicated in this case and he is ready and willing to abide by any stringent condition that may be imposed on him. https://hcservices.ecourts.gov.in/hcservices/
4. The learned Additional Public Prosecutor would submit that there is no change of circumstances after the previous order was passed on merits. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.
5. Taking into consideration the bad antecedents of the petitioner, this Court had dismissed the earlier petition filed by the petitioner and that there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. -sd/- 22/06/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
