Petition filed under Article 226 of The Constitution of India praying to issue a writ of mandamus to consider the petitioner's application dated 31/05/2010 in Ref SP/10/08302 and direct the second respondent to grant patta.

ORDER

The petitioner, placing reliance upon the sale deed of the year 1999, made an application dated 31.05.2010 to the 2nd respondent seeking issuance of patta. The petitioner also enclosed Encumbrance Certificate along with the said application. As the said application, has not been considered, the present writ petition has been filed.

2. Though it is stated that the application is pending from 2010 onwards, the petitioner has not taken any action so far. 3.

Thus, the petitioner is directed to give fresh representation to the 2nd respondent within a period of two weeks from the date of receipt of a copy of this order and on receipt of the same, the 2nd respondent shall consider the same and pass appropriate orders, on merits and in accordance with law, within a period of eight weeks thereafter, after affording an opportunity of hearing to the petitioner as well as to the as well as to any third party if any.
