Respondents Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus, directing the 1st respondent to extend the time by permitting the petitioner to complete the certificate course in computer on office automation,within a period of 6 months based on the representation of the petitioner dated 20.05.2017 in accordance with rule 33(1) of the Tamil Nadu Government Servants Conditions of Service Act 2016.

ORDER

[Order of the Court was made by N.ANAND VENKATESH, J.] The petitioner has filed this writ petition seeking for a writ of mandamus directing the first respondent to extend the period of six months for completing the certificate course in computer automation.

2. A counter affidavit has been filed by the second respondent, wherein in paragraph No.10, it has been stated as follows:

"10. The petitioner passed Computer on Office Automation Course in the examination held in the month of December 2017. Now, even though the petitioner passed and acquired the test qualification, since she acquired necessary qualification after expiry of five years period, in view of Rules 31(4) of Tamil Nadu Government Servants (Conditions of Service) Act, 2016, she cannot be declared that she completed probation."

3. In view of the completion of the course, even as admitted by the second respondent, the condition, that was prescribed initially, has now been fulfilled by the petitioner.

4. Recording the stand taken by the second respondent, this writ petition is disposed of by making it clear that no further action shall be taken against the petitioner in this regard. No costs.
