This Writ Petition filed under Article 226 of the Constitution of India praying for issuance a Writ of Mandamus to direct the 3rd respondent herein viz., the District Revenue Officer, Sriperumpudur, Kancheepuram District to release the car of the petitioner herein viz., Honda Amaze Black colour car bearing Registration No.TN-10-AR-5541 to the custody of the petitioner herein forthwith. O R D E R
(Order of the Court was made by C.V.KARTHIKEYAN, J.) The relief sought for in the present writ petition is to release the vehicle Honda Amaze Black colour car bearing Registration No.TN-10-AR-5541 to the custody of the petitioner herein.
2. The scope of the writ petition is very narrow. The vehicle had been seized by the 3rd respondent viz., District Revenue Officer, Sriperumpudur, Kancheepuram District.
3. The learned standing counsel for the respondents stated that the vehicle would be released in the course of the day with proper identification and acknowledgment of the petitioner. The said statement stands recorded. Since that statement is recorded, we are not inclined to go into the merits of the case. It is also represented that the vehicle is at present at RTO office, Maduravoyal. The petitioner is directed to approach the said office and also the 3rd respondent/District Revenue Officer who is directed to release the vehicle on proper identification and proper acknowledgment of the petitioner and also on undertaking by the petitioner, if any, required. With the above observation, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
