ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offences under Section Section 20(b) (ii) (A) of NDPS Act, 1985 in Crime No.152 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 26.03.2021, the respondent police was on patrol, the petitioner along with other accused were selling ganja, on seeing the police, they left their vehicle and flew away, on search, 300 gms of ganja was found in the vehicle. Hence, the case was registered against the petitioner.

3. The learned counsel appearing for petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution. He further submitted that A1 was granted anticipatory bail by this court in Crl.OP.No.7885 of 2021 dated 27.04.2021. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned counsel appearing for the respondent would submit that there are totally two accused. The petitioner/A2 along with other accused were selling ganja of 300 gms. He further submitted that this petitioner is having eight previous cases against him, out of which, two cases are similar in nature and he was also detained in Goondas Act. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the facts of the case and this petitioner is having eight previous cases against him and he was also detained in Goondas Act, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly this petition is dismissed.
