Criminal Original Petition filed under Section 482 Cr.P.C. to direct the 1st respondent to register the complaint against the 2nd respondent dated 20.09.2015 as duly presented in person before him, investigate into the same and take appropriate action in accordance with law.

O R D E R

This petition has been filed to direct the 1st respondent to register the complaint against the 2nd respondent dated 20.09.2015 as duly presented in person before him, investigate into the same and take appropriate action in accordance with law.

2. The petitioner has lodged a complaint as against one Anuradha Jayaraman, the 2nd respondent herein on the allegation that the 2nd respondent had informed the petitioner that she is having political influence and she could secure a job for the petitioner's wife as Assistant Engineer in Electricity Board and asked the petitioner to pay a sum of Rs.7 lakhs. When the petitioner was not able to mobilise the said huge amount, she induced the petitioner to pay atleast Rs.4 lakhs. Hence, the petitioner pledged the jewels of his wife and also obtained loan from various sources and paid Rs.4 lakhs to her. Inspite of it, https://hcservices.ecourts.gov.in/hcservices/

she did not secure the job. Later, the petitioner realised that he was cheated and hence, he lodged a complaint. Since no action was taken so far, the present petition has been filed.

3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents.

4. Learned Additional Public Prosecutor submitted that the money was paid by the petitioner at Otteri. If the petitioner gives a fresh complaint before Inspector of Police, Otteri Police Station, Chennai, necessary action will be taken.

5. Considering the submissions made on either side, this Court directs the petitioner to give a fresh complaint to the Inspector of Police, Otteri Police Station, Chennai, along with a copy of this order within a period of one week from the date of receipt of a copy of this order. On receipt of the same, the Inspector of Police, Otteri Police Station, Chennai , is directed to enquire the matter and if the materials gathered indicates any cognizable offence, he is directed to proceed further in accordance with law. In the course of investigation, if no prima facie is made out or the matter is civil in nature, he is directed to pass appropriate orders on the complaint made by the petitioner.

6. The criminal original petition is disposed of accordingly.
