Respondents Prayer : Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus to call for the records pertaining to the proceedings of the 3rd respondent in Ka.No.U.Po/E & Pa/Kundrathur Rural/Ko:Min Inaippu/A.No.42/15 dated 06.07.2015 as illegal, incompetent and ultravires and consequently direct the 3rd respondent to give electricity connection to the petitioner residential house at No.3/38, Anbu Salai, Sirukalathur Village, Chennai 600 069.

O R D E R

Heard Mr.R.Jayaprakash, learned counsel appearing for the petitioner and Mr.R.Rajeswaran, learned Special Government Pleader appearing for 1st respondent and Mr.S.K.Raameshwar, learned counsel appearing for Respondents 2 and 3. With the

consent of both parties, the Writ Petition is taken up for final disposal.

2. The petitioner has filed this Writ petition to quash the impugned proceedings dated 6.7.2015 and direct the 3rd respondent to give Electricity connection to his residential house.

3. It is stated that the 3rd respondent is ready and willing to give connection providing the petitioner satisfies the requirements in terms of regulation 27 of the Tamilnadu Electricity Distribution Act, 2004.

4. Learned counsel for the petitioner has submitted that all the necessary documents including Indemnity Bond has been furnished to the 3rd respondent and the 3rd respondent is inclined to positively consider his application.

5. In the light of the subsequent development, there will be a direction issued to the 3rd respondent to take out the documents given by the petitioner and if the same is in order, after furnishing appropriate Indemnity Bond, he is directed to proceed further to grant Electricity Supply to the petitioner subject to other conditions within a period of four weeks from the date of receipt of a copy of this order.

With the above direction,this Writ Petition is disposed of. No costs.
