This Application is to condone the delay of 271 days in filing the written statement. The cause for delay is twofold as per the affidavit. First, the parties were engaged in negotiation but went in vain. Second, due to covid pandemic, the limitation is extended in the light of the Supreme Court order passed in Suo Moto Writ Petition No.3 of 2020. 2.Learned counsel for the respondent/plaintiff submitted that the first reason not a ground to condone the delay. However, the second ground may be taken into consideration for condoning the delay. 3.On hearing the learned counsels, this Court is of the view that in order to give an opportunity to contest the matter on merit, though the delay is beyond the prescribed period of limitation, the same is condoned in the light of the supreme court direction.
