ORDER
Petition filed under Section 482 of Cr.P.C, to set aside the order passed by the learned Metropolitan Magistrate for Exclusive Trial of CCB cases and CBCID Metro Cases Egmore, Chennai, in Crl.M.P.No.3554 of 2022 dated 10.02.2023.
2.It is the contention of the learned counsel for the petitioner that the petitioner has filed a petition in Crl.M.P.No.3554 of 2022 dated 10.02.2023 before the learned Metropolitan Magistrate for Exclusive Trial of CCB cases (relating to cheating cases in Chennai) and CBCID Metro Cases Egmore, Chennai, seeking modification of the condition imposed on him in Crl.M.P.No.2195 of 2023, wherein he was directed to appear before the respondent police daily at 10.00 a.m. and 5.00 p.m. and the same was dismissed by the trial Court on the ground that modifying the said condition may obstruct the investigation of the case. Hence the present petition. 3.Learned Government Advocate (Crl. Side) would vehemently oppose the petition seeking setting aside the 2/4
modification petition filed by the petitioner on the ground that the petitioner has not appeared and signed before the respondent police since the date of bail and the investigation of the case is pending. In these circumstances, if the condition imposed on the petitioner is modified, the petitioner may not cooperate with the investigation of the case and there are chances of him getting absconded. 4.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side).
5.Considering the facts and circumstances of the case, the condition imposed on the petitioner in Crl.M.P.No.2195 of 2023 dated 20.01.2023 by the trial Court to appear before the respondent police daily at 10.00 a.m. and 5.00 p.m. is modified to the effect that the petitioner shall appear before the respondent police everyday at 10.00 a.m. until further orders.
