Petition filed under Article 226 of the Constitution of India for the issuance of writ of mandamus, directing the respondents to dispose of the petitioner's representation dated 27.10.2014 and thereby direct the respondents 1 and 2 to disburse the petitioner husband's Life Time Arrears of payment is pending from 21.05.2012 to 31.05.2012 Provident Fund arrears and the Karunaithogai (Fully) Rs.2 00 000/- with interest to the Petitioner and not to petitioner's father in law name Thiru.Murugaiyan the 3rd respondent herein.

The petitioner is the widow of Thiru.M.Thangavel, who worked as Office Assistant in Thanthai Periyar Transport Department Servants - House Building Society Sangam, Villupuram. Her husband https://hcservices.ecourts.gov.in/hcservices/

died on 21.05.2012. It is the grievance of the petitioner that the second respondent failed to pay her the benefits on account of the death of the employee. The petitioner therefore submitted a representation on 27.10.2014 requesting the second respondent to pay her the benefits. However, there was no follow up action taken by the second respondent, presumably under the premise that the third respondent has also made a claim in his capacity as fatherin-law.

2. The second respondent is directed to consider and dispose of the representation submitted by the petitioner dated 27.10.2014 on merits and as per law with notice to the third respondent. Such exercise shall be completed within a period of two months from the date of receipt of a copy of this order.

3. The writ petition is disposed of with the above direction. No costs.
