The petitioners in Crl.O.P.No.10312 of 2023, who were arrested and remanded to judicial custody on 18.02.2023 at the hands of the respondent 436 IPC and Section 4 of TNPPDL Act, in Crime No.32 of 2023, seek bail.

2. The petitioner in Crl.O.P.No.10320 of 2023, who was arrested and remanded to judicial custody on 15.03.2023 at the hands of the respondent 436 IPC and Section 4 of TNPPDL Act, in Crime No.31 of 2023, seeks bail.

3. The petitioner in Crl.O.P.No.10323 of 2023, who was arrested and remanded to judicial custody on 15.03.2023 at the hands of the respondent 436 IPC and Section 4 of TNPPDL Act, in Crime No.32 of 2023, seeks bail.

4. The petitioner in Crl.O.P.No.10324 of 2023, who was arrested and remanded to judicial custody on 14.03.2023 at the hands of the respondent 436 IPC and Section 4 of TNPPDL Act, in Crime No.47 of 2023, seeks bail.

5. The petitioners in Crl.O.P.No.10333 of 2023, who were arrested and remanded to judicial custody on 18.02.2023 at the hands of the respondent police for the offences punishable under Sections 457, 380 IPC @ 457, 380, 436 IPC and Section 4 of TNPPDL Act, in Crime No.31 of 2023, seek bail.

6. The petitioner in Crl.O.P.No.10338 of 2023, who was arrested and remanded to judicial custody on 15.03.2023 at the hands of the respondent 436 IPC and Section 4 of TNPPDL Act, in Crime No.47 of 2023, seeks bail.

7. The petitioner in Crl.O.P.No.10365 of 2023, who was arrested and remanded to judicial custody on 14.03.2023 at the hands of the respondent

436 IPC and Section 4 of TNPPDL Act, in Crime No.31 of 2023, seeks bail.

8. The petitioner in Crl.O.P.No.10410 of 2023, who was arrested and remanded to judicial custody on 14.03.2023 at the hands of the respondent 436 IPC and Section 4 of TNPPDL Act, in Crime No.32 of 2023, seeks bail.

9. The petitioners in Crl.O.P.No.10469 of 2023, who were arrested and remanded to judicial custody on 21.02.2023 at the hands of the respondent police for the offences punishable under Sections 457, 380 IPC @ 457, 380, 436 IPC and Section 4 of TNPPDL Act, in Crime No.47 of 2023, seek bail.

10. The case of the prosecution is that the petitioners are hailing from Haryana. The petitioners along with other accused broken the ATM at various places and committed theft of huge amount and also set fire with an intent to destroy the ATM and caused huge damage. Hence the complaints.

11. The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case and they are no way connected with the offence as alleged by the prosecution. Hence, he prays for grant of bail to the petitioners.

12. The learned Additional Public Prosecutor submitted that the petitioners along with other accused broken the ATM at various places and committed theft of huge amount and also set fire with an intent to destroy the ATM and caused huge damage to the society. Hence, he vehemently opposed to grant bail to the petitioners.

13. It is seen that the petitioners are hailing from Haryana. The petitioners along with other accused broken the ATM at various places and committed theft of huge amount and also set fire with an intent to destroy the ATM and caused huge damage to the society. So far no substantial recovery is made from the petitioners. Therefore, the custodial interrogation of the petitioners is very much required in these cases. If the petitioners are let out

on bail, they would commit the similar offence.

14. Taking into consideration of the above facts and circumstances of the case, since the petitioners have committed very serious offence as against the society, this Court is not inclined to grant bail to the petitioners.

15. Accordingly, these Criminal Original Petitions are dismissed. 05.05.2023 mn
