ORDER
The writ petition has been filed to issue a mandamus to the respondents to pay the petitioners the interest for the belated payment of terminal benefits viz., Provident Fund, Gratuity, Surrender Leave Salary and Earned Leave Salary at the rate of 12% per annum, within a time frame to be fixed by this Court.

The case of the petitioners is that they have been appointed in the respondent-Transport Corporation on 06.09.1986, 21.04.1982 and 06.10.1995 respectively and retired from on attaining the age of superannuation on 30.09.2022, 31.05.2018 and 31.03.2023. However, the terminal benefits have been settled to the petitioners only on 22.05.2023, 26.08.2019 and 30.10.2024 respectively and no interest has been paid to them for the delayed period. Therefore, the petitioners had submitted individual representations to the respondent on 04.03.2026, 02.03.2026 and 21.01.2026, to pay the interest for the delayed period. Since the same were not considered, the present writ petition has been filed.

The learned Standing Counsel for the respondent would fairly submit that the respondent is willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount. 2/4

Heard the learned counsel for both sides and perused the materials available on record.

In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondent to pay interest at the rate of 6% per annum for the belated payment of admissible terminal benefits from the date of retirement till the date of actual disbursal of the terminal benefits to the petitioners, within a period of six weeks from the date of receipt of a copy of this order.
